How long does it take to get Probate?

The length of time it may take to get Probate in England and Wales depends on all sorts of issues, for example:

  1. How big or complex the estate is.
  2. How well the deceased kept records.
  3. Whether is is the first of a couple who has died or the second.
  4. How efficient the person or firm doing the work is.
  5. How inefficient the people holding assets or to whom money is owed are in replying to. letters – some take months to provide essential information and even charge for it.
  6. How long it takes to work out and raise the money to pay any tax due.
  7. How long the wait is at the Probate Registry – even when you have been to swear the oath, there are usually a couple more weeks to wait before you obtain the grant and then.
  8. Start collecting in and distributing the assets but.
  9. Bear in mind creditors have up to 6 months after the grant to submit claims.

How long does it take to get Probate?

It typically takes anything up to 6 months to get the grant and therefore the authority to collect the assets in – often quicker, sometimes longer.  Unlike many firms, we appreciate that the wait can be very long, and, provided there is no doubt  whatever as to the assets and beneficiaries we endeavour to make at least a partial pay out as early as possible while the fine tuning continues.   But no promises!
